Terms of Use
1. Introduction
These Terms govern your use of the bimsy iPhone app ("the App"), made by Politechaos ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App. Apple's standard Licensed Application End User License Agreement also applies.
2. What the App does, and its limits (important)
The App uses artificial intelligence to identify insects and other small crawling creatures from a photo and to describe the risks they may carry. It is provided for general information only.
- It can be wrong. An identification or risk level may be inaccurate or incomplete. A photo may not show the features needed to tell similar species apart.
- It never confirms that a creature is safe. A risk the App does not mention is a risk it is not presenting, not one it has ruled out. "Unknown" means the App could not judge.
- It is not professional advice. The App is not a substitute for a doctor, a veterinarian, a pest-control professional or an entomologist. Never delay seeking medical help because of something the App showed you. If someone has been bitten or stung and feels unwell, contact a medical professional or your local emergency number.
3. Free scans and Bimsy Pro
The App includes a number of free scans. Bimsy Pro is an optional auto-renewable subscription, offered weekly or yearly, that unlocks unlimited scanning. Prices are shown in the App before you buy.
- Payment is charged to your Apple ID account when you confirm the purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- If an offer includes a free trial, any unused part of the trial ends when you buy a subscription.
- You can manage or cancel your subscription in your Apple ID account settings. Refunds are handled by Apple under its policies.
To limit abuse, the identification service limits how many requests one installation can make in a short period. This applies to every user and is not a cap on Bimsy Pro.
4. Acceptable use
Do not misuse the App or its identification service: do not attempt to access it other than through the App, overload it, or reverse engineer it.
5. Intellectual property
The App and its content, including its text, field guide and design, belong to Politechaos or its licensors. Photos you take remain yours.
6. Limitation of liability
To the fullest extent permitted by law, the App is provided "as is", and Politechaos is not liable for any indirect, incidental or consequential damages, or for any injury, illness, property damage or loss arising from reliance on the App's identifications. Nothing in these Terms limits liability that cannot be limited by law, or your rights under the mandatory consumer law of your country.
7. Changes
We may update these Terms. The "Last updated" date shows the latest version. Continuing to use the App after a change means you accept the updated Terms.
